For purposes of these Terms, "Services" means the Charter-Care website and any related products, services, or communications that reference these Terms.

By accessing or using our Services, you agree to be bound by these Terms. If you do not agree to these Terms, you should not use our Services.

These Terms explain how Charter-Care operates, what you can expect when using our Services, and the responsibilities of both you and Charter-Care. They should be read together with our Privacy Policy, which explains how we collect, use, share, protect, and retain Personal Information.

Who We Are

Charter-Care is operated by NexLevel Direct, LLC and provides a consent-driven marketing platform that helps connect individuals requesting information about Medicare-related insurance products and services with licensed insurance agents, insurance agencies, insurance carriers, and other organizations authorized to respond to those requests.

Charter-Care also operates a lead routing platform designed to securely transmit consumer requests to appropriate organizations while supporting compliance with applicable legal and contractual requirements.

Charter-Care is not an insurance company, insurance agency, licensed insurance producer, enrollment platform, or government agency. We do not recommend insurance products, determine eligibility for insurance coverage, make enrollment decisions, or issue insurance policies. Those activities are performed by licensed insurance professionals and applicable insurance carriers.

Our Services

Charter-Care provides a consent-driven marketing platform that helps individuals request information about Medicare-related insurance products and services from licensed insurance agents, insurance agencies, insurance carriers, and other organizations authorized to respond to those requests.

When you submit a request through our Services, Charter-Care collects the information you choose to provide, documents your request and any applicable consent, and routes your information to one or more organizations that may respond to your request. Depending on the nature of your request, more than one organization may receive your information.

Charter-Care's role is limited to facilitating these connections. We do not recommend insurance products, compare plans, determine eligibility, provide insurance advice, or make enrollment decisions. Any information, recommendations, or offers you receive are provided by the organizations that respond to your request.

The availability of licensed insurance professionals, insurance products, or other services may vary based on your location, eligibility, and other factors. Submitting a request through Charter-Care does not guarantee that you will be contacted, offered insurance coverage, or enrolled in any insurance plan.

Eligibility

You may use the Services only if you are at least 18 years of age and are legally able to enter into a binding agreement under applicable law.

By using the Services, you represent that the information you provide is accurate and that you are submitting information on your own behalf or are otherwise authorized to do so.

If you do not meet these requirements, you should not use the Services.

Your Responsibilities

When using the Services, you agree to provide accurate information, use the Services lawfully, submit requests only on your own behalf or with authorization, maintain the security of your devices, and comply with these Terms and applicable law.

You agree not to submit false or fraudulent information, impersonate another person, interfere with the Services, attempt unauthorized access, misuse automated tools, or otherwise violate applicable law.

If we reasonably believe the Services are being used in violation of these Terms or applicable law, we may suspend or restrict access.

Communications

Charter-Care operates a consent-driven platform. When you request information through our Services, you may be contacted by Charter-Care, licensed insurance agents, insurance agencies, insurance carriers, or other organizations authorized to respond to your request.

Depending on your request and the consent you provide, communications may occur by telephone, email, SMS text message, or other legally permitted methods.

Intellectual Property

The Services and their content are owned by or licensed to NexLevel Direct, LLC and are protected by applicable intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, revocable license to use the Services for personal, non-commercial purposes.

Except as permitted by law or with our prior written permission, you may not reproduce, modify, distribute, or otherwise exploit the Services.

Acceptable Use

To help maintain the security, reliability, and integrity of the Services, you agree not to use them in any way that could interfere with their operation or violate applicable law.

You agree not to access systems without authorization, introduce malicious code, scrape or harvest data, interfere with the Services, submit fraudulent requests, or circumvent security measures.

We reserve the right to investigate suspected misuse and suspend, restrict, or terminate access where appropriate.

Third-Party Services

Once your request has been routed, your interactions with responding organizations are separate from your relationship with Charter-Care.

Charter-Care does not control the products, services, websites, communications, or business practices of those organizations. Their terms and privacy practices govern your relationship with them.

Service Disclaimers

Charter-Care facilitates requests for information but does not recommend insurance products, compare plans, determine eligibility, provide insurance advice, or make enrollment decisions.

We do not guarantee uninterrupted availability of the Services, that you will be contacted, or that you will qualify for or enroll in any insurance plan.

To the fullest extent permitted by law, the Services are provided "as is" and "as available."

Limitation of Liability

To the fullest extent permitted by law, NexLevel Direct, LLC d/b/a Charter-Care will not be liable for indirect, incidental, consequential, special, exemplary, or punitive damages arising from your use of the Services.

Nothing in these Terms limits liability where prohibited by law.

Suspension, Termination, and Changes to the Services

We may suspend, restrict, terminate, modify, update, discontinue, or replace any part of the Services as reasonably necessary to protect consumers, maintain security, comply with legal obligations, or support business operations.

Changes to These Terms

We may update these Terms from time to time. Material changes will be reflected by updating the Last Updated date and providing any additional notice required by law. Continued use of the Services constitutes acceptance of the revised Terms.

Governing Law

These Terms are governed by the laws of the State of Washington. Legal actions relating to these Terms must be brought in Washington unless applicable law requires otherwise.

General Legal Terms

If any provision is unenforceable, the remaining provisions remain effective. Failure to enforce a provision is not a waiver. These Terms, together with the Privacy Policy and incorporated policies, constitute the entire agreement. Charter-Care may assign these Terms in connection with a merger, acquisition, or sale of assets.
